Tort-"reform" Backing Insurance Company Commits Fraud on the Court

A Texas court has ruled that Texas Mutual Insurance Company, a big backer of tort reform, committed fraud by falsifying a medical record in pending litigation.

The company filed suit to attempt to overturn a state of Texas ruling that a person suffered injuries in a work-place accident. After finding that the record was falsified, the Court held that the insurance company had no additional evidence to refute the prior ruling finding injury and dismissed the insurance company's case.

According to the attorney for the injured victim:

The evidence is clear that Texas Mutual not only falsified the original medical record, but, after being caught, secretly solicited from a doctor yet another altered document which an official of Dallas County Hospital District later confirmed under oath was not a genuine record of the Hospital District.

It is this type of frivolous defense conduct that hurts the system more than any alleged frivolous lawsuits being filed, but you don't hear about these as much from the popular press.
