      <title>Swimming Pool Safety</title>
      <description>&lt;p&gt;Yesterday, I noted the increased importance of &lt;a href="http://austin.injuryboard.com/miscellaneous/boating-safety.aspx?googleid=240908"&gt;boating safety&lt;/a&gt; as summer approaches. However, I would be remiss if I didn't have some tips for &lt;a href="http://www.redcross.org/services/hss/tips/healthtips/safetywater.html#children"&gt;swimming pool safety&lt;/a&gt;.Unfortunately, d&lt;a href="/topic/pool-accidents.aspx"&gt;rowning accidents&lt;/a&gt; are thesecond leading cause of death of children under 14. The Red Cross offers these tips:&lt;/p&gt;
&lt;p&gt;1.Maintain constant supervision no matter how skilled you believe your child to be.&lt;/p&gt;
&lt;p&gt;2.Do not use substitutes for supervision. While life jackets, floaties or the like can help, they are no substitute for a caring parent watching out for his or her child.&lt;/p&gt;
&lt;p&gt;3.Teach your kids water safety. Enroll them in swimminglessons and other safety courses that teach them to be safe around the water.&lt;/p&gt;
&lt;p&gt;However, from the lawsuit perspective, themost important silent killer is the &lt;a href="/topic/swimming-pool-drains.aspx"&gt;swimming pool drain accidents.&lt;/a&gt; Swimming pool drains often seem innocent enough and attract the attention of young children. Unfortunately, many kids are killed or injured when the force in the drain is enough to hold them under the water, drowning them, or even disemboweling the children that choose to sit on a drain.       <title>Personal Injury Lawyer Seeks Recusal of Supreme Court Judges in Wrongful Death Case, continued</title>
      <description>&lt;p&gt;We earlier posted about a personal injury lawyer that filed a motion to recuse four of our Texas Supreme Court Justices from hearing a &lt;a href="http://austin.injuryboard.com/general-personal-injury/lawyer-seeks-recusal-of-judges-in-wrongful-death-case.php"&gt;wrongful death case&lt;/a&gt;.  The motion, which alleged that the justices were biased in favor of defendants, was based in large part on a law review article by a UT professor that found the Court ruled in favor of defendants in 2004 and 2005 over 80% of the time.  Not surprisingly, &lt;a href="http://texaslawyer.typepad.com/texas_lawyer_blog/2007/09/we-dont-need-no.html"&gt;the court denied the motion today&lt;/a&gt;.       <title>Lawyer Seeks Recusal of Judges in Wrongful Death Case</title>
      <description>&lt;p&gt;The plaintiffs in a &lt;a href="http://www.law.com/jsp/tx/PubArticleTX.jsp?id=1189674157501"&gt;wrongful death suit have sought the recusal of Texas Supreme Court justices &lt;/a&gt;Dale Wainwright, Scott Brister, Wallace Jefferson, and Nathan Hecht.  A Motion to Recuse is a motion asking that a judge not hear a case, usually because the judge has some involvement or bias.  This lawyer's motion is based in large part on a study performed by University of Texas Law Professor David Anderson that found defendants won 87% of the personal injury cases heard by the court in 2004 and 2005.  The lawyer alleges that his clients' fate should not be determined by Supreme Court justices "who have been shown to have probably determined the outcome of their case already."
